4.   Board of Trustees

  1.  

    (1)   The Fund shall be administered by a Board of Trustees consisting of—

    1.  

      (a)     a person representing the Saint Lucia Teachers Union;

    1.  

      (b)     a person representing the Saint Lucia Principals Association;

    1.  

      (c)     a person representing the National Youth Council and not less than 2 and not more than 4 other members, to be appointed by the Minister by instrument in writing.

    (2)   The chairperson shall be designated by the Minister.

  1.  

    (3)   A member shall be appointed for such term, not exceeding 3 years as may be determined by the Minister and shall be eligible for re-appointment.

    (4)   A member may be removed by the Minister for inability or unwillingness to act or for impropriety in the discharge of his or her function as a member of the Board.

    (5)   Where a member of the Board appointed under subsection 1(a), (1)(b) or (1)(c) is removed in accordance with subsection (4), the Minister shall request that an alternative representative be nominated by the organisation which the member removed represented.

    (6)   A member, other than the chairperson, may at any time resign his or her office by instrument in writing addressed to the Minister and transmitted through the chairperson and from the date of receipt of the instrument by the Minister that person shall cease to be a member of the Board.

    (7)   Where a vacancy occurs in the membership of the Board, the Minister may where necessary, after consultation with the organisation which nominated the person for membership, appoint a person to act for the remainder of the term specified in the instrument of appointment of the person whose membership became vacant.
