9.   Damaging, and denying access to computer system

  1.  

    (1)   Subject to section 13, a person shall not, knowingly and without lawful authority, do any act which causes, directly or indirectly—

    1.  

      (a)     a degradation, failure, interruption or interference or obstruction of the operation of a computer system;

    1.  

      (b)     a denial of access to, or impairment of any program or data stored in, the computer system;

    1.  

      (c)     the data to be meaningless, useless or ineffective;

    1.  

      (d)     an obstruction, interruption, or interference with any person in the lawful use of data; or

    1.  

      (e)     the destruction or alteration of data.

    (2)   A person who contravenes subsection (1) commits an offence and is liable on summary conviction to a fine not exceeding $50,000 or to imprisonment for a term not exceeding 18 months or both and in the case of a subsequent conviction, to a fine not exceeding $100,000 or to imprisonment for a term not exceeding 3 years or both.

    (3)   Subsection (1) applies whether the person's act has a temporary or permanent effect.
