(1) A person shall not cause a computer system to perform any function for the purpose of securing access to any program or data held in a computer system, or in any other computer system with intent to commit an offence—
(a) involving property, fraud, dishonesty or which causes bodily harm; and
(b) which is punishable with imprisonment.
(2) A person who contravenes subsection (1) commits an offence and is liable on summary conviction to a fine not exceeding $50,000 or to imprisonment for a term not exceeding one year.
(3) For the purposes of this section, it is immaterial that the—
(a) access referred to in subsection (1) is authorized or unauthorized; and
(b) offence to which this section applies is committed at the same time when the access is secured or at any other time.
