17.   Disclosure of preserved data

An authorized person may, for the purposes of a criminal investigation or the prosecution of an offence, apply ex parte to a Judge in Chambers for an order for the disclosure of—

  1.  

    (a)     any data subject to a preservation order under section 16, irrespective of whether one or more service providers were involved in the transmission of that data;

  1.  

    (b)     sufficient data referred to in paragraph (a) to identify the service providers and the path through which the data was transmitted;

  1.  

    (c)     the password enabling access to the data referred to in paragraph (a); or

  1.  

    (d)     the public key enabling the interpretation of data referred to in paragraph (a) that is in an asymmetric cryptosystem.
