16.   Preservation order

  1.  

    (1)   Where a police officer or an authorized person has reasonable grounds to believe that data stored or processed by means of a computer system or other information communication technologies is vulnerable to loss or modification and where such data is required for the purposes of a criminal investigation or the prosecution of an offence, the Director of Public Prosecutions may apply ex parte to a Judge in Chambers on behalf of the police officer or authorized person for an order for the expeditious preservation of the data.

    (2)   For the purposes of subsection (1), “data” includes traffic data and subscriber information.

    (3)   An order made under subsection (1) remains in force—

    1.  

      (a)     until such time as may reasonably be required for the investigation of the offence;

    1.  

      (b)     where prosecution is instituted, until the final determination of the case; or

    1.  

      (c)     until such time as the Judge in Chambers determines or considers necessary.
