10.   Unauthorized disclosure of password

  1.  

    (1)   Subject to section 13, a person shall not, knowingly and without lawful authority, disclose a password, access code, or any other means of gaining access to a program or data held in a computer system—

    1.  

      (a)     for any wrongful gain;

    1.  

      (b)     for any unlawful purpose; or

    1.  

      (c)     knowing that it is likely to cause prejudice to another person.

    (2)   A person who contravenes subsection (1) commits an offence and is liable on summary conviction to a fine not exceeding $10,000 or to imprisonment for a term not exceeding 3 months or both and in the case of a subsequent conviction, to a fine not exceeding $20,000 or to imprisonment for a term not exceeding 6 months or both.
