CHAPTER SIXTH
PETITORY ACTIONS, OR ACTIONS FOR RECOVERY OF LAND

    768.   The proprietor of any immovable or real right may bring a petitory action against any one in possession of his or her property or rights. If he or she have brought a possessory action he or she cannot institute a petitory one before the possessory one has been discontinued or adjudicated upon.

    769.   The plaintiff may demand in addition to the restoration of the land, that the rents, issues, and profits of the property, and any damages he or she may have suffered be awarded him or her.

    770.   The defendant in a possessory action may bring a petitory action upon giving security that he or she will conform to the judgment and pay all damages and costs which may be awarded against him or her in the possessory action.

    771.   The defendant in a petitory action may claim by his or her plea whatever amounts he or she may be entitled to for improvements. He or she, however, has no claim for improvements made after the institution of the action, unless they were of absolute necessity.
