9.   Responsibility to apply to register a birth and form of application

  1.  

    (1)   Subject to subsections (2) and (3), if the birth of a child must be registered in Saint Lucia, the following persons shall apply in the prescribed form to the District Registrar to register the birth—

    1.  

      (a)     the mother;

    1.  

      (b)     either parent of the child if the parents are married; or

    1.  

      (c)     if the child was found abandoned as a newborn or if the mother died before registration of the child, the person in whose care the child is.

  1.  

    (2)   If the District Registrar does not receive an application under subsection (1), the District Registrar may require any one of the following persons to apply to register the birth—

    1.  

      (a)     the person in charge of the place where the child was born;

    1.  

      (b)     a person present at the birth; or

    1.  

      (c)     a person who the District Registrar reasonably believes knows the relevant facts.

  1.  

    (3)   A person shall, unless with reasonable excuse, comply with a request of the District Registrar under subsection (2).

    (4)   A person who fails to comply with this section commits an offence and is liable on summary conviction to a fine not exceeding $2,500.
