28.   Offences

  1.  

    (1)   A person shall not—

    1.  

      (a)     wilfully give any false answer to any question put to him or her by a District Registrar relating to the particulars required to be registered concerning any birth or death, or wilfully give to a District Registrar any false information concerning any birth or death, or the cause of death;

      (b)     wilfully make any false certificate or declaration under or for the purposes of this Act, or forge or falsify any such certificate or declaration or any order under this Act, or knowing any such certificate, declaration or order to be false or forged use the same as true or give or send the same as true to any person;

      (c)     wilfully make, give or use any false statement or representation that a child is born alive having been still-born, or as to the body of a deceased person or still-born child in any coffin, or falsely pretend that any child born alive was still-born;

      (d)     make any false statement with intent to have the statement entered in any Register of Births or Deaths; (Amended by Act 10 of 2014)

      (e)     wilfully provide false information or fraudulent documents to the Registrar in an application to rectify his or her record of civil status; (Inserted by Act 10 of 2014)

      (f)     wilfully provide false information or fraudulent documents to the Registrar in an application to register a child or to include information of the parental details of a child. (Inserted by Act 10 of 2014)

    (2)   A person who contravenes subsection (1) commits an offence and is liable on conviction to a fine not exceeding $10,000 or to imprisonment for a term not exceeding 2 years.
