DEATH

19.   Death in a house or elsewhere

  1.  

    (1)   Where a person dies in a dwelling house it is the duty of —

    1.  

      (a)     the nearest relatives of the deceased who are present at the time of death or in attendance during the last illness of the deceased;

    1.  

      (b)     in default of the relatives referred to in paragraph (a), of every other relative of the deceased dwelling or being in the same District as the deceased; or

    1.  

      (c)     in default of the relatives referred to in paragraphs (a) and (b), each person present at the death, and the occupier of the dwelling house in which, to his or her knowledge the death took place; and

    1.  

      (d)     in default of the persons referred to in paragraphs (a), (b) and (c), the person causing the body of the deceased person to be buried,

to give to the best of his or her knowledge and belief to the District Registrar of the district in which the death took place, within 48 hours of the death, information of the particulars required to be registered concerning such death, and specified in the form prescribed.

    (2)   Where a person dies in a place which is not a dwelling house, or a dead body is found elsewhere than in a dwelling house, it is the duty of —

    1.  

      (a)     every relative of the deceased person having knowledge of any of the particulars required to be registered concerning the death; or

    1.  

      (b)     in default of such relative, of any person present at the death, and of every person finding or taking charge of the body,

to give to the District Registrar within 48 hours of the death such information in the prescribed form as is required to be registered concerning the death.

    (3)   Subject to section 22, a person who fails to comply with subsection (1) commits an offence and is liable on summary conviction to a fine not exceeding $2,500.
