11.   Registration of parental details

  1.  

    (1)   This section applies if a person makes an application—

    1.  

      (a)     to register the birth of a child; or

    1.  

      (b)     to include information about the identity of a child's parent in the Register of Births after the child's birth has been registered.

  1.  

    (2)   The District Registrar shall not include information that identifies a person as the parent of a child unless—

    1.  

      (a)     the person signed a birth registration application and the District Registrar is satisfied that the person is a parent of the child; or

    1.  

      (b)     the District Registrar is entitled under Book Seventh of the Civil Code to presume that the person is the parent of the child.

  1.  

    (3)   The District Registrar may include information about the identity of a parent who did not sign the birth registration application if the Registrar is satisfied that the parent did not sign because—

    1.  

      (a)     the parent is dead; or

    1.  

      (b)     the parent is unable to sign the application.

  1.  

    (4)   The District Registrar may include information about the identity of a parent who did not sign the birth registration application if the person who claims that someone else who is a parent of the child proves it by giving the District Registrar a copy of a court order to that effect or by such other means as is prescribed.

  1.  

    (5)   Notwithstanding subsection (1), (2), (3) or (4), the father of a child of an unwed mother may by affidavit depose to the child's paternity, and if the affidavit is supported by the affidavit of the unwed mother deposing that the father is indeed the father of the child, the District Registrar shall upon receipt of the affidavits, no later than the 6 month period for registering a birth under section 10, enter the name of the father in the Register of Births.
