47.   Order for diversion

  1.  

    (1)   If before the conclusion of a case for the prosecution it comes to the attention of the Court that a child acknowledges or intends to acknowledge responsibility for an alleged offence, the Court may make an order for diversion in respect of the child if the Director of Public Prosecutions indicates that the matter may settled by diversion.

    (2)   If the Court makes an order for diversion, it shall postpone the proceedings pending the compliance of the child with the diversion order.

    (3)   The Court may, on receipt of a report from an assigned officer that a child has successfully complied with a diversion order, acquit the child of all charges.

    (4)   An acquittal may be made in the absence of the child.
