(1) Subject to subsection (2) and section 8, if the person is brought before the judicial authority under section 6(4), the judicial authority shall order that the requested person be —
(a) surrendered to the issuing State Party;
(b) committed to a correctional facility until the requested person is surrendered to the issuing State Party.
(2) The judicial authority making an order under subsection (1) shall make the order if the judicial authority is satisfied at the proceedings for the requested person's surrender that the person is the requested person and must be surrendered.
