2013 SUPPLEMENT TO THE REVISED EDITION OF THE LAWS (COMMENCEMENT) ORDER – SECTION 10(1)

Commencement [26 May 2015]

WHEREAS by section 10(1) of the Revised Edition of the Laws Act, Cap.1.07 it is provided that a revised edition of the Laws or a part or parts of a revised edition of the Laws shall come into force as the authoritative version of the law on an effective date specified in an Order made by the Attorney General;

AND WHEREAS section 10(3) of the said Act provides that the Attorney General may, by Order published in the Gazette, declare that a revised edition of the Laws specified in the Order shall come into force on such date as may be appointed by such Order;

AND WHEREAS by virtue of section 10(4) of the said Act, an Order in respect of a revised edition of the Laws or a part or parts of the revised edition of the Laws shall not be made until after the passing of a Resolution of Parliament authorizing the making of such an Order;

AND WHEREAS pursuant to section 10 of the said Act, Parliament passed a Resolution, enacted as Statutory Instrument No. 30 of 2015, authorizing the Attorney General to make an Order declaring the effective date of the 2013 Supplement to the Revised Edition of the Laws of Saint Lucia;

AND WHEREAS by virtue of section 10(5) of the said Act, it is provided that the revised edition of the Laws or a part of parts of the revised edition of the Laws shall be deemed to be, in all Courts of justice and for all purposes whatsoever, without any question, the sole authentic edition of the Laws of Saint Lucia in respect of the law contained therein and in force on the relevant revision date;

NOW THEREFORE by virtue of section 10 of the said Act, the Attorney General makes this Order:

1.   Citation

This Order may be cited as the 2013 Supplement of the Revised Edition of the Laws (Commencement) Order, 2015.

2.   Commencement

The 2013 Supplement to the Revised Edition of the Laws of Saint Lucia set out in the Schedule to this Order shall come into force on the publication of this Order in the Gazette.

WHEREAS by section 10(1) of the Revised Edition of the Laws Act, Cap.1.07 it is provided that a revised edition of the Laws or a part or parts of a revised edition of the Laws shall come into force as the authoritative version of the law on an effective date specified in an Order made by the Attorney General;

AND WHEREAS section 10(3) of the said Act provides that the Attorney General may, by Order published in the Gazette, declare that a revised edition of the Laws specified in the Order shall come into force on such date as may be appointed by such Order;

AND WHEREAS by virtue of section 10(4) of the said Act, an Order in respect of a revised edition of the Laws or a part or parts of the revised edition of the Laws shall not be made until after the passing of a Resolution of Parliament authorizing the making of such an Order;

AND WHEREAS pursuant to section 10 of the said Act, Parliament passed a Resolution, enacted as Statutory Instrument No. 52 of 2018, authorizing the Attorney General to make an Order declaring the effective date of the 2014 Supplement to the Revised Edition of the Laws of Saint Lucia;

AND WHEREAS by virtue of section 10(5) of the said Act, it is provided that the revised edition of the Laws or a part of parts of the revised edition of the Laws shall be deemed to be, in all Courts of justice and for all purposes whatsoever, without any question, the sole authentic edition of the Laws of Saint Lucia in respect of the law contained therein and in force on the relevant revision date;

NOW THEREFORE by virtue of section 10 of the said Act, the Attorney General makes this Order:

RESOLUTION OF PARLIAMENT TO AUTHORIZE THE MAKING OF AN ORDER FOR THE 2017 SUPPLEMENT TO THE REVISED EDITION OF THE LAWS – SECTION 10(3)

RESOLUTION

WHEREAS by section 10(3) of the Revised Edition of the Laws Act, it is provided that the Attorney General may, by Order published in the Gazette, declare that a revised edition of the Laws of Saint Lucia specified in the Order shall come into force on such date as may be appointed by the Order;

AND WHEREAS by section 10(4) of the Revised Edition of the Laws Act, it is provided that an Order in respect of a complete revised edition of the laws shall not be made until after the passing of a resolution of Parliament authorizing the making of such an Order;

AND WHEREAS by section 13(5) of the Revised Edition of the Laws Act, it is provided that a replacement, insertion, deletion or amendment pursuant to that section shall have no effect unless made under and in accordance with the Order of the Attorney General under section 10(3);

AND WHEREAS it is further provided by section 13(6) of the Revised Edition of the Laws Act, that a revised edition in whatever format, marked with the latest revision date is deemed to be the authoritative revised edition of the laws to which section 10(4) applies;

BE IT RESOLVED that Parliament do authorize the Attorney General to make an Order to declare that the 2017 Supplement to the Revised Edition of the Laws of Saint Lucia, as specified in the Order shall come into force on such date as may be appointed by such Order, as an authoritative version of the law.

1.   Citation

This Order may be cited as the Revised Edition of the Laws of Saint Lucia (Rectification of Errors) Order.

2.   Rectification of error in Bills of Sale Act

Schedule 3 of the Bills of Sale Act, is rectified by deleting the words, “When the consideration money does not exceed the sum of $150.00 $50.00” and by replacing the words, “When the consideration money does not exceed the sum of $150.00 $0.50”.

RESOLUTION OF PARLIAMENT TO AUTHORIZE THE MAKING OF AN ORDER FOR THE 2019 SUPPLEMENT TO THE REVISED EDITION OF THE LAWS – SECTION 10(3)

RESOLUTION

WHEREAS by section 10(3) of the Revised Edition of the Laws Act, it is provided that the Attorney General may, by Order published in the Gazette, declare that a revised edition of the Laws of Saint Lucia specified in the Order shall come into force on such date as may be appointed by the Order;

AND WHEREAS by section 10(4) of the Revised Edition of the Laws Act, it is provided that an Order in respect of a complete revised edition of the laws shall not be made until after the passing of a resolution of Parliament authorizing the making of such an Order;

AND WHEREAS by section 13(5) of the Revised Edition of the Laws Act, it is provided that a replacement, insertion, deletion or amendment pursuant to that section shall have no effect unless made under and in accordance with the Order of the Attorney General under section 10(3);

AND WHEREAS it is further provided by section 13(6) of the Revised Edition of the Laws Act, that a revised edition in whatever format, marked with the latest revision date is deemed to be the authoritative revised edition of the laws to which section 10(4) applies;

BE IT RESOLVED that Parliament do authorize the Attorney General to make an Order to declare that the 2019 Supplement to the Revised Edition of the Laws of Saint Lucia, as specified in the Order shall come into force on such date as may be appointed by such Order, as an authoritative version of the law.

2019 SUPPLEMENT TO THE REVISED EDITION OF THE LAWS (COMMENCEMENT) ORDER – SECTION 10(1)

WHEREAS by section 10(1) of the Revised Edition of the Laws Act, (the Act) it is provided that a revised edition of the Laws or a part or parts of a Revised Edition of the Laws shall come into force as the authoritative version of the law on an effective date specified in an Order made by the Attorney General;

AND WHEREAS section 10(3) of the Act provides that the Attorney General may, by Order published in the Gazette, declare that a revised edition of the Laws specified in the Order shall come into force on such date as may be appointed by the Order;

AND WHEREAS by virtue of section 10(4) of the Act, an Order in respect of a revised edition of the Laws or a part or parts of the Revised Edition of the Laws shall not be made until after the passing of a Resolution of Parliament authorizing the making of such an Order;

AND WHEREAS pursuant to section 10 of the Act, Parliament passed a Resolution, enacted as Statutory Instrument, No. 190 of 2021, authorizing the Attorney General to make an Order declaring the effective date of the 2019 Supplement to the Revised Edition of the Laws of Saint Lucia;

AND WHEREAS by virtue of section 10(5) of the Act, it is provided that the revised edition of the Laws or a part of parts of the Revised Edition of the Laws shall be deemed to be, in all Courts of justice and for all purposes whatsoever, without any question, the sole authentic edition of the Laws of Saint Lucia in respect of the law contained therein and in force on the relevant revision date;

NOW THEREFORE by virtue of sections 10 of the Act, the Attorney General makes this Order:

This Order may be cited as the 2019 Supplement of the Revised Edition of the Laws (Commencement) Order.

2.   Commencement

The 2019 Supplement to the Revised Edition of the Laws of Saint Lucia, including the laws set out in the Schedule to this Order, comes into force on the publication of this Order in the Gazette.
