3.   Power to administer oaths

  1.  

    (1)   Every court, judge, or magistrate and every person having, by law or consent of parties, authority to hear and receive evidence, shall have power to administer or cause to be administered an oath to every witness who is legally called to give evidence before that court, judge or person.

    (2)   An officer of a court or authority who in fact administers an oath is, prima facie, deemed, for all purposes, to have been duly authorised to administer the oath.
