5. Immunities and privileges of Secretariat

(1) The Commonwealth Secretariat shall have the immunities and privileges set out in Part I of the Schedule to the Act but the immunity from suit and legal process conferred on the Commonwealth Secretariat by this Order shall not include immunity from suit and legal process in respect of—
1. (a) a civil action for damage alleged to have been caused by a motor vehicle belonging to or operated on behalf of the Commonwealth Secretariat or in respect of a traffic offence involving such a motor vehicle; or
1. (b) arbitration proceedings relating to any written contract entered into by or on behalf of the Commonwealth Secretariat.

(2) Subsection (1) shall not be construed as authorising the enforcement of any judgement or arbitration award by execution on the premises or official archives of the Commonwealth Secretariat.
