6.   Confidentiality protections

  1.  

    (1)   For the purposes of Paragraph 5 of the Arrangement, the Competent Authority and any person employed in carrying out the provisions of or having any official duty under the Agreement shall have regard to the confidentiality protections under Article 4(6), (7) and (8) of the Agreement between the Government of the United States and the Government of Saint Lucia for the Exchange of Information with respect to taxes, the text of which is set out in Schedule 3, with respect to the documents and information, which may come into the possession or knowledge of the Competent Authority or person for the exchange of information under the Agreement.

    (2)   The confidentiality protections under subsection (1) continues to apply to a person despite him or her having ceased to be employed in carrying out the provisions of or having any official duty under the Agreement.

    (3)   A person who fails to comply with the confidentiality protections under subsection (1) commits an offence and is liable on summary conviction to a fine not exceeding $10,000 or a term of imprisonment not exceeding 2 years.
