11.   Pension and living allowance payable to surviving widow or widower of Governor General

  1.  

    (1)   Subject to subsections (3) and (4), there shall be granted to the surviving widow or widower of a person who has held the office of Governor General, with effect from the date of death of that person or from 1 January 2005 whichever is later, an annual pension equivalent to 2/3 of the highest annual pension which would have been granted to that person under section 7(1) if—

    1.  

      (a)     the death had not occurred; and

    1.  

      (b)     that person had ceased to hold the office of Governor General.

  1.  

    (2)   Subject to subsections (3) and (4), there shall be payable to the surviving widow or widower of a person who has held the office of Governor General, with effect from the date of death of that person or from 1 January 2005 whichever is later, a monthly living allowance equal to 2/3 of the monthly living allowance which would have been payable to that person under section 7(2) if—

    1.  

      (a)     the death had not occurred; and

    1.  

      (b)     that person had ceased to hold the office of Governor General.

    (3)   Subsections (1) and (2) shall apply regardless of whether the person dies while holding office or after ceasing to hold the office of Governor General.

    (4)   A widow or a widower shall cease to receive an annual pension under subsection (1) and a monthly living allowance under subsection (2) if the widow or widower becomes the Governor General or the Prime Minister.
