BY HIS EXCELLENCY THE GOVERNOR GENERAL

A PROCLAMATION

SIR EMMANUEL NEVILLE CENAC

GCSL., GCMG.,

GOVERNOR GENERAL.

WHEREAS it is enacted by section 17(1) of the Constitution of Saint Lucia, that the Governor General may, by proclamation which shall be published in the Gazette, declare that a state of emergency exists for the purposes of Chapter 1 of the Constitution of Saint Lucia;

AND WHEREAS section 17(2) of the Constitution of Saint Lucia, provides that a proclamation under section 17(1) shall not be effective unless it contains a declaration that the Governor General is satisfied —

  1.  

    (a)     that a public emergency has arisen as a result of the imminence of a state of war between Saint Lucia and a foreign state;

  1.  

    (b)     that a public emergency has arisen as a result of the occurrence of any earthquake, hurricane, food, fire, outbreak of pestilence or of infectious disease, or other calamity whether similar to the foregoing or not; or

  1.  

    (c)     that action has been taken, or is immediately threatened, by any person, of such a nature and on so extensive a scale, as to be likely to endanger the public safety or to deprive the community or any substantial portion of the community of supplies or services essential to life;

AND WHEREAS by virtue of section 17(1) and (2) of the Constitution of Saint Lucia, Cap. 1.01 the Governor General, by proclamation, declared a state of emergency for the purposes of Chapter 1 of the Constitution of Saint Lucia, published in the Gazette on the 3rd day of February, 2021 as the Constitution of Saint Lucia – Proclamation for Declaration of State of Emergency, Statutory Instrument, No. 27 of 2021;

AND WHEREAS by virtue of section 17(3) of the Constitution of Saint Lucia, Parliament, approved the declaration of a state of emergency that was published in the Gazette on the 3rd day of February, 2021 as Statutory Instrument No. 27 of 2021, by the Constitution of Saint Lucia – Resolution of Parliament Approving Declaration of State of Emergency, Statutory Instrument, No. 38 of 2021;

AND WHEREAS by virtue of section 17(6) of the Constitution of Saint Lucia, Parliament further extended for an additional period, the declaration of a state of emergency that was passed as Statutory Instrument, No. 38 of 2021, by the Constitution of Saint Lucia – Further Extension of Resolution of Parliament Approving Declaration of State of Emergency, Statutory Instrument, No. 77 of 2021;

AND WHEREAS it is enacted by section 17(4) of the Constitution of Saint Lucia, that a declaration of a state of emergency may at any time be revoked by the Governor General by Proclamation published in the Gazette;

NOW THEREFORE I, EMMANUEL NEVILLE CENAC, Governor General of Saint Lucia, by this Proclamation do hereby revoke the Constitution of Saint Lucia – Proclamation for Declaration of State of Emergency, Statutory Instrument, No. 27 of 2021.
