(1) A contractor shall not transfer, assign or sub-contract the performance of a public procurement contract or any part of a performance of a public procurement contract without obtaining, in writing, the consent of the procuring entity, but the procuring entity shall not unreasonably withhold its consent.
(2) Consent to a sub-contract shall be granted on condition that the contractor remains fully responsible for all obligations as set out in the public procurement contract and that the sub-contractor has proof of the necessary technical qualifications relating to the works under the sub-contract.
